The renter assumes all
liabilities for use of any and all

The owners, operators and authorized agents of EZRetreat.com in
no way guarantee or warrant the accuracy, or truthfulness of the
descriptions or accuracy of the photographs contained in any of
the postings found on EZRetreat.com. Additionally, property
owners often make minor changes in the contents of their
properties, potential renters are encouraged to enquire as to
the accuracy of any description or photograph posted on
EZRetreat.com.
Cancellation
policies, if any, are set by the respective property owner or
their authorized agents, and not by the owners or authorized
agents of EZRetreat.com. Renters, or prospective renters are
urged to enquire about and, if necessary, receive in writing,
any descriptions of cancellation policies from the property
owners or their authorized agents. Under no circumstances, shall
EZRetreat.com be responsible for the cancellation, for any
reason, of any property listed on EZREtreat.com. Additionally,
EZRetreat.com shall not be responsible, for any reason, for a
refund of any rental fees a renter or prospective renter feels
they may be entitled to.
During any time
period that you, as a renter of a vacation rental property, are
renting a property, you may not, under any circumstances,
re-rent that property to a third party.
As a renter, a
vacation property owner may require that you pay a deposit to
reserve a property. This deposit may be held until return of the
unit in good, un-damaged condition. Or, a vacation property
owner may apply it towards final payment of the rental property.
It is the responsibility of the renter to ensure all conditions
of the rental of the property are acceptable to the renter.
EZRetreat.com shall in no way moderate or attempt to help settle
any disputes that arise in the rental of vacation property. As a
renter, you may be subject to losing this deposit if you do not
fulfill the obligations spelled out by the property owner. A
renter is always urged to review the contract fully and
understand all aspects of the rental contract before signing and
returning the contract to the vacation property owner or their
agents.
Vacation Property Owners
The owners, operators or authorized agents of EZRetreat.com
neither warrant nor guarantee that EZRetreat.com shall be
available 100% of the time. Regularly scheduled maintenance or
temporary outages may be experienced at any time. Please be
assured that every attempt shall be made to minimize any such
outages. If
the owners, operators or authorized agents of EZRetreat.com
are unable to provide the promised level of service, including,
but not limited to service outages, maintenance outages, acts of
war, acts of God or negligence, neither
EZRetreat.com, its owners, agents or authorized agents shall be
held liable for any costs beyond the prorated costs paid by the
vacation property owner, for the services which were not
provided. EZREtreat.com shall not be held responsible for any
undelivered email inquiries or for any missed income as a result
of undelivered email inquiries.
Property owners
may advertise one physical property at one physical location per
listing. Multiple properties in one listing are expressly
forbidden and are subject to immediate cancellation without
notice or refund. Once published, a listing may not be moved.
For example; if you sell your currently listed vacation property
and purchase another, you may not transfer the posted listing
to another property. You may, however, transfer the rights to
the listing to the new owner as outlined in the refund policy.
EZRetreat.com does
not hold any funds or in any way act as an agent between the
vacation property owners and their renters or potential owners.
Vacation Property
Owners are expected to adhere to all local, state and federal
laws as well as maintaining their property in good condition, in
a safe and habitable condition. Additionally, owners are
expected to be current on all bills and fees that pertain to the
listed property, as well as, but not limited to any permits,
taxes, and licenses. Obviously, its not fair to a renter of
your property to experience any outages or temporary disruptions
of service due to an owners negligence. EZRetreat.com, its
owners, operators or authorized agents shall have no
responsibility for any misrepresentations made by a vacation
property owner using an EZRetreat.com listing.
As an owner of a
vacation rental property, you are urged to get a signed contract
with any renters of your vacation property. Additionally,
EZRetreat.com urges you to investigate your renters or possible
renters. EZRetreat.com, its owners, operators or authorized
agents shall assume no responsibility for the quality or fitness
of renters that may contact you through property listings on our
site.
EZREtreat.coms
owners, operators and authorized agents reserve the right to not
accept or modify, at our discretion, any property listing,
deemed un-acceptable for any reason.
EZRetreat.coms
policy on Spam
EZRetreat.com
does not participate, allow or condone any unsolicited commercial
email, otherwise known as SPAM. EZRetreat.com, its owners,
operators or authorized agents may, at its discretion cancel
without notice and without refund any listing that in our
judgment, that mentions or refers to EZRetreat in any way shape
or form. Furthermore, any un-authorized use of the name, URL,
email address or any other recognized property of EZRetreat.com
is prohibited.
Rental Inquirys
originate at the EZRetreat.com servers. Every attempt is made to
mitigate the possible use of the rental inquiry form to send
unsolicited email. If you, as a vacation property owner, receive
unsolicited email that you believe originated from
EZRetreat.com rental inquiry form, we urge you to contact us
immediately. Every attempt will be made to mitigate this type of
usage. Furthermore, inquiries made from the EZRetreat.com should
not be considered as private, as the owners, operators and
authorized agents of EZRetreat.com may monitor random emails in
an attempt to ensure the rental inquiry form is not used in any
un-authorized manner.
This Agreement
shall be construed in accordance with the laws of the United
States, and the state of Colorado. Any and all disputes shall be
submitted to the jurisdiction of the state of Colorado,
disregarding conflicts of law, forum and venue.
